Masks Off? or Masks On? A History of the CDC’S Consistently Inconsistent Advice on Face Coverings | Waking Times & Open Source Truth

The US Centers for Disease Control and Prevention has stayed true to form by deciding that its current mask guidance – not to be confused with its previous and repeatedly revised guidance – needs to be reversed. Again.

It’s a shame so many Americans do not appreciate the new rules concerning the use of face coverings among the fully vaccinated. After all, asking jabbed citizens to mask up after telling them they don’t need to mask up, after suggesting to them that wearing two masks almost all the time would be even better, must be the best possible and most consistent public health policy under the current circumstances.

Enough, already: The historical record is self-explanatory. The CDC, together with America’s trusted public-health bureaucrats, have always pursued evidence-based policymaking and have never once bowed to mass panic. The below timeline should finally put to rest all the feeble-minded moaning leveled against US health authorities during these trying times.

November 2004

The CDC publishes guidance in response to “questions about the role of masks for controlling influenza when suboptimal immunization of the public could increase the frequency of influenza infection” – a surprisingly topical issue, almost 20 years later.

Masks are not usually recommended in non-health-care settings, the advisory states. The CDC explains that, even though flu symptoms can take up to a week to appear, there is no apparent benefit from asymptomatic individuals wearing face coverings.

“No recommendation can be made at this time for mask use in the community by asymptomatic persons, including those at high risk for complications, to prevent exposure to influenza.”

April 2009

The CDC issues recommendations for the use of face masks and respirators in areas where H1N1 ‘swine flu’ has been detected.

“Information on the effectiveness of facemasks and respirators for the control of influenza in community settings is extremely limited,” the agency explains. Face coverings should only be used when caring for sick individuals or in other specific circumstances, the CDC says, adding that “relying” on masks for protection in crowded settings is ill-advised. The health authority maintains this position throughout the duration of the pandemic.

As Covid-19 begins to spread across the globe, Anthony Fauci, director of the US National Institute of Allergy and Infectious Diseases and the chief medical adviser to the president, receives an email from a former senior US government official asking if she should wear a mask while traveling, as a precautionary measure.

He advises against it: “The typical mask you buy in the drug store is not really effective in keeping out [the] virus, which is small enough to pass through the material.”

“Seriously people- STOP BUYING MASKS! They are NOT effective in preventing general public from catching #Coronavirus,” US Surgeon General Dr. Jerome Adams tweets. He adds that ordinary Americans should focus more on hand-washing and other sanitary measures, and let healthcare workers wear the masks – advice in perfect harmony with years-old CDC guidance. The tweet is later deleted, but the internet never forgets.

A month after the Trump administration declares a public health emergency due to the coronavirus outbreak, Fauci says in an interview with 60 Minutes: “There’s no reason to be walking around with a mask. When you’re in the middle of an outbreak, wearing a mask might make people feel a little bit better and it might even block a droplet, but it’s not providing the perfect protection that people think that it is.”

In keeping with longstanding CDC guidance, he stresses that masks should be reserved for healthcare providers and those who are ill.

In an article dunking on Donald Trump’s suggestion that Americans could wear scarves to shield their faces from Covid-19, NBC facetiously reports“While the science behind whether masks can prevent a person from catching the coronavirus hasn’t changed (a mask does not help a healthy person avoid infection), public guidance may be shifting.” In the same article, the outlet stresses that there is “no scientific evidence that wearing face coverings would have a measurable impact on flattening the coronavirus curve.”

On the same day, CNN reports that Fauci supports “broadening” mask use among the general public, provided there are enough face coverings for healthcare workers.

“Because if, in fact, a person who may or may not be infected wants to prevent infecting somebody else, the best way to do that is with a mask. Perhaps that’s the way to go,” Fauci declares, in a bold U-turn from his previous position on the matter.

The CDC’s FAQ page about Covid-19 reads“CDC does not recommend that people who are well wear a facemask to protect themselves from respiratory illnesses, including Covid-19. You should only wear a mask if a healthcare professional recommends it. A facemask should be used by people who have Covid-19 and are showing symptoms.”

Americans are suddenly informed that facemasks should actually be worn by just about everyone.As cities across the United States begin to lock down, the CDC advises Americans to voluntarily don cloth face masks, purportedly in a data-backed bid to help halt the virus. President Trump explains that the new guidance is prompted by concerns that seemingly healthy people are transmitting the disease: “You don’t seem to have symptoms and it still gets transferred.”

More than a decade of established public health policy goes out the window: The public should mask up. But not with medical-grade respirators – those are reserved for healthcare workers. Instead, people are urged to don cloth masks, which can be made at home in accordance with FDA manufacturing protocols.

The Masked War against Asymptomatic Spread of a Respiratory Virus –  long regarded by the CDC as an unnecessary and futile endeavor – begins.

April 4, 2020

The CDC updates its FAQ page about Covid-19. Citing “new data about how Covid-19 spreads, along with evidence of widespread Covid-19 illness in communities across the country,” the agency now recommends the use of cloth face coverings. They should be worn by “people older than 2 years of age in public settings where other social distancing measures are difficult to maintain.” The CDC stresses that these new recommendations do not apply to people who are “unconscious.”

May – December 2020

At the direction of the CDC, state and local governments begin to impose mask mandates. ‘Karens’ do battle with maskless grocery shoppers across the country. General chaos and deep paranoia ensue.

An article in the British Medical Journal notes that the whole debate seems rather silly considering that PCR tests do not distinguish live virus and therefore cannot reliably identify “asymptomatic” individuals: “As things stand, a person who tests positive with any kind of test may or may not have an active infection with live virus, and may or may not be infectious.”

February 10, 2021

The CDC publishes a study of its own claiming that two face masks – colloquially known as “double masking” – can reduce an individual’s exposure to coronavirus particles.

However, the agency notes that the findings do not mean that Americans should wear two disposable masks at the same time. Instead, the data points to why “wearing a well-fitting mask is so important.”

Everyone is very impressed, but by now masks are not in fashion. Millions of vaccinated Americans, who’d been told that getting jabbed would give them unprecedented protection against Covid-19, begin to wonder why they are being nudged to put on another mask instead of being encouraged to take off the face-covering that they’re already wearing. Patience, little lambs.

Finally: Fully vaccinated Americans don’t need to wear masks when meeting indoors with close friends and family who have also been jabbed, the CDC announces. Vaccinated individuals are still warned against traveling or gathering in large groups.

The CDC says that fully vaccinated people can forgo masks at small outdoor gatherings. However, masks are still recommended when attending large outdoor events. Vaccinated individuals should also limit nursing home visits to “compassionate care situations.”

Americans who are fully vaccinated against Covid-19 do not need to wear masks or adhere to social distancing rules indoors or outdoors, except under certain circumstances, the CDC announces.

Fauci tells CNBC that “the broad overall CDC recommendation is that if you are vaccinated, you are protected and you don’t need to wear a mask indoor or outdoors.” He then suggests that people living in areas with a “high level of transmission” should mask up anyway.

“If you want to go the extra mile of safety, even though you’re vaccinated, when you’re indoors, particularly in crowded places, you might want to consider wearing a mask,” he says, seconds after citing CDC guidance stating the exact opposite.

Citing the spread of the more infectious Delta strain, the CDC recommends that fully vaccinated Americans living in areas with “substantial or high transmission” of Covid-19 should once again resume wearing masks indoors.

The agency also says that masks should be required of all staff and pupils at K-12 schools. Vaccinated individuals should wear face coverings when around family members who have compromised immune systems, or children who are too young to get the shot, the CDC further advises.

Heads down, masks up

So there you have it. As this modest historical survey demonstrates, the CDC, Fauci, and the entire US medical establishment have shown tremendous bravery as they diligently pursue this week’s rendition of The Science. Evidence can change over time. But only with masks does it seem to turn on a dime.

Americans live in the best of all possible masked worlds, and they have Anthony Fauci and the CDC to thank for it.

University Lab Analysis: Children’s Masks Found to Contain 11 Dangerous Pathogens | Becker News

A University of Florida laboratory analysis of a sample of children’s masks suggests that masking young, healthy persons may not only be unnecessary, it may be harmful to their health. The results of a small sample of masks showed the presence of 11 dangerous pathogens, including the bacteria that cause pneumonia, tuberculosis, diphtheria, and meningitis. The results were shown by the group Rational Ground.

A group of parents in Gainesville, FL, sent 6 face masks to a lab at the University of Florida, requesting an analysis of contaminants found on the masks after they had been worn,” Rational Ground said. “The resulting report found that five masks were contaminated with bacteria, parasites, and fungi, including three with dangerous pathogenic and pneumonia-causing bacteria. Although the test is capable of detecting viruses, including SARS-CoV-2, only one virus was found on one mask (alcelaphine herpesvirus 1).”

The analysis detected the following 11 dangerous pathogens on the masks:

  • Streptococcus pneumoniae (pneumonia)
  • Mycobacterium tuberculosis (tuberculosis)
  • Neisseria meningitidis (meningitis, sepsis)
  • Acanthamoeba polyphaga (keratitis and granulomatous amebic encephalitis)
  • Acinetobacter baumanni (pneumonia, blood stream infections, meningitis, UTIs—resistant to antibiotics)
  • Escherichia coli (food poisoning)
  • Borrelia burgdorferi (causes Lyme disease)
  • Corynebacterium diphtheriae (diphtheria)
  • Legionella pneumophila (Legionnaires’ disease)
  • Staphylococcus pyogenes serotype M3 (severe infections—high morbidity rates)
  • Staphylococcus aureus (meningitis, sepsis)

“Half of the masks were contaminated with one or more strains of pneumonia-causing bacteria,” the report added. “One-third were contaminated with one or more strains of meningitis-causing bacteria. One-third were contaminated with dangerous, antibiotic-resistant bacterial pathogens. In addition, less dangerous pathogens were identified, including pathogens that can cause fever, ulcers, acne, yeast infections, strep throat, periodontal disease, Rocky Mountain Spotted Fever, and more.”

The lab analysis conducted by the University of Florida’s Mass Spectrometry Research and Education Center studied six “new or freshly-laundered before wearing and had been worn for 5 to 8 hours, most during in-person schooling by children aged 6 through 11.” One mask was submitted by an adult for comparison. No pathogens were found on ‘control’ (unworn) masks.

Ms. Amanda Donoho, one of the parents who requested the lab analysis, points to the need for more research: “We need to know what we are putting on the faces of our children each day. Masks provide a warm, moist environment for bacteria to grow.”

The risk posed by the SARS-CoV-2 virus to children is statistically negligible. The CDC’s latest figures show that 324 children with SARS-CoV-2 have died with the virus out of more than 100,000,000 people under 18 in the United States. An estimated 95% of those cases are highly at-risk children with 4 or more comorbidities, according to the CDC. For comparison, the CDC reports that “in 2018, 636 children 12 years old and younger died in motor vehicle traffic crashes, and more than 97,000 were injured.”

Futhermore, there are surging concerns about the “Delta variant,” which is being used as a rationale to reinstate mask mandates. The early data on the “Delta variant” shows a 99.9% case survival rate, as shown by U.K. government data that was reported by Jordan Schachtel. Vaccinations for adults, and especially for seniors and at-risk adults, appear thus far to be mitigating the mortality rate of the Delta variant.

Furthermore, a Centers for Disease Control advisory group released a statement on the ‘likely link’ between COVID-19 vaccinations and rare heart inflammation cases for young persons on Wednesday. In over 300 cases of reported myocarditis or pericarditis, a Pfizer/BioNTech and Moderna COVID-19 vaccination preceded the heart condition.

The COVID-19 Vaccine Safety Technical (VaST) Work Group noted the adverse reaction in vaccinated males between the ages of 16 and 24. The development of the heart condition was observed in adolescents and young adults and was considerably higher after the second dose in males.

Earlier, the Centers for Disease Control and Prevention endorsed the use of the experimental Pfizer-BioNTech coronavirus vaccines in children as young as 12. That position has not yet been revised.

What are the ingredients of Pfizer’s COVID-19 vaccine? | Technology Review

Reading the ingredient list is like looking at the side of a cereal box, except that you need a degree in organic chemistry to understand it. We got help from various scientists and biotech entrepreneurs to understand what each of the ingredients does and make some educated guesses about others.

The mRNA

Pfizer’s vaccine is the first on the market that consists of actual genetic information from a virus in the form of messenger RNA, or mRNA, a type of molecule whose usual job is to transport copies of genetic instructions around a cell to guide the assembly of proteins. Imagine an mRNA as a long ticker tape carrying instructions. It’s fairly delicate stuff, and that’s why Pfizer’s vaccine needs to be kept at around -100 °F (-73 °C) until it’s used.

The new vaccine, delivered as a shot in the arm muscle, contains an RNA sequence taken from the virus itself; it causes cells to manufacture the big “spike” protein of the coronavirus, which the pathogen uses to glom onto a person’s cells and gain entry. On its own, without the rest of the virus, the spike is pretty harmless. But your body still reacts to it. This is what leaves you immunized and ready to repel the real virus if it turns up.

The mRNA in the vaccine, to be sure, isn’t quite the same as the stuff in your body. That’s good, because a cell is full of defenses ready to chop up RNA, especially any that doesn’t belong there. To avoid that, what’s known as “modified nucleosides” have been substituted for some of the mRNA building blocks.

But Pfizer is holding back a little. The spike gene sequence can be tweaked in small ways for better performance, by means that include swapping letters. We don’t think Pfizer has said exactly what sequence it is using, or what modified nucleosides. That means the content of the shot may not be 100% public.

The lipids

The Pfizer vaccine, like one from Moderna, uses lipid nanoparticles to encase the RNA. The nanoparticles are, basically, tiny greasy spheres that protect the mRNA and help it slide inside cells.

These particles are probably around 100 nanometers across. Curiously, that’s about the same size as the coronavirus itself.

Pfizer says it uses four different lipids in a “defined ratio.” The lipid ALC-0315 is the primary ingredient in the formulation. That’s because it’s ionizable—it can be given a positive charge, and since the RNA has a negative one, they stick together. It’s also a component that can cause side-effects or allergic reactions. The other lipids, one of which is the familiar molecule cholesterol, are “helpers” that give structural integrity to the nanoparticles or stop them from clumping. During manufacturing, the RNA and the lipids are stirred into a bubbly mix to form what the FDA describes as a “white to off-white” frozen liquid.

Salts

The Pfizer vaccine contains four salts, one of which is ordinary table salt. Together, these salts are better known as phosphate-buffered saline, or PBS, a very common ingredient that keeps the pH, or acidity, of the vaccine close to that of a person’s body. You’ll understand how important that is if you’ve ever squeezed lemon juice on a cut. Substances with the wrong acidity can injure cells or get quickly degraded.

Sugar

The vaccine includes plain old sugar, also called sucrose. It’s acting here as a cryoprotectant to safeguard the nanoparticles when they’re frozen and stop them from sticking together.

Saline solution

Before injection, the vaccine is mixed with water containing sodium chloride, or ordinary salt, just as many intravenously delivered drugs are. Again, the idea is that the injection should more or less match the salt content of the blood.

No preservatives

Pfizer makes a point of saying its mixture of lipid nanoparticles and mRNA is “preservative-free.” That’s because a preservative that’s been used in other vaccines, thimerosal (which contains mercury and is there to kill any bacteria that might contaminate a vial), has been at the center of worries around over whether vaccines cause autism. The US Centers for Disease Control says thimerosal is safe; despite that, its use is being phased out. There is no thimerosal—or any other preservative—in the Pfizer vaccine. No microchips, either.

The vaccine is still known by the code name BNT162b, but once it’s authorized, expect Pfizer to give it a new, commercial name that conveys something about what’s in it and what it promises for the world.

Americans Are Suffering ‘Delusional Psychosis’ About CCP Virus, Psychiatrist Claims | The Epoch Times

So much misinformation and exaggeration about the lethality of the CCP virus—also known as the novel coronavirus—has been broadcast by government officials and the media that many Americans are suffering from a “delusional psychosis,” according to Los Angeles child and adolescent psychiatrist Dr. Mark McDonald.

What began as fear of a then-unknown disease called COVID-19 has since evolved into what McDonald described to The Epoch Times on Dec. 1 as a national condition in which “there is a delusional psychosis that has taken over where people are impervious to rational thinking.”

“They don’t want to give up the mask, they don’t want to give up the social distancing,” he said. “[People] are impervious to reason, to logic, to education at this point. They are psychotically managed by their fear.”

McDonald says the condition is most prevalent in Los Angeles, where he practices, and New York, places that he described as “ground zero for this.”

The government-imposed controls that were initially temporary in March have been repeatedly extended for months and have now “become social controls exercised by us,” he said.

“It’s actually coming from us, our parents, our children, our neighbors; it’s coming from businesses, corporations.”

McDonald noted that several of his friends were banned out of fear of the contagion from being with their families during Thanksgiving and will be at Christmas as well, despite having no symptoms of the disease.

“I have shopkeepers who have assistants who will not step forward to the counter to hand food to people, including me if I’m not wearing a mask,” he said.

“I have people who are yelling at me if I get into an elevator without a mask to go 10 seconds up to another floor, so we don’t need policing any more, we just need each other.”

Noting that approximately 268,000 people have died because of the CCP virus in the United States, compared to an annual average of 45,000 flu deaths and about 600,000 cancer deaths, The Epoch Times asked McDonald how he puts such figures in perspective.

“Well, first, I think the keyword here is perspective,” McDonald said. “When New York Mayor Bill de Blasio started to shut down New York City, close restaurants, bars, schools, basically put everybody in a state of house arrest, he said, ‘If these policies that I am enacting save one life, it will be worth it.’

“That is idiocy. We do not ever make public health policy based on saving one life. We look at perspective, we look at cost, we look at assets.”

McDonald said federal data on CCP virus deaths “are highly suspect” because the Centers for Disease Control and Prevention (CDC) has acknowledged that “94 percent of the deaths had an average of three co-morbidities, meaning they were probably going to die within the next 6 to 12 months anyway.” The 94 percent figure refers to coronavirus death cases, in which the official certificate of death named the disease.

McDonald said more than half of those who died were 80 years old or older, while the average life expectancy, based on all causes of death, in the United States is currently 79 years.

“So, if half of the people who have died purportedly of coronavirus are over the age of 80 and they had three or more co-morbidities, that speaks to the fact those people died with it rather than of it,” he said.

How deaths of individuals with both coronavirus and co-morbidities should be classified statistically has been an area of debate among officials, statisticians, and public health policymakers since the onset of the disease.

McDonald also pointed to a recent lecture by a Johns Hopkins University economist who, based on CDC data, suggested total deaths due to all causes in the United States for 2020, compared to the previous eight years, don’t reflect a massive increase attributable to the disease.

“All of this points to no evidence that COVID-19 created any excess deaths. Total death numbers are not above normal death numbers,” said the lecturer, professor Genevieve Briand.

Shortly after the school’s student newspaper reported the lecture, however, the story was retracted because, the editors said, the study “has been used to support dangerous inaccuracies that minimize the impact of the pandemic.”

The editors further claimed that the lecturer’s claim that the data shows no excess deaths attributable to the disease contradicted a CDC claim of 300,000 such deaths. The CDC page from the agency’s COVID Data Tracker cited by the editors didn’t make such a claim.

McDonald said he views the CDC “as no longer credible, [because] they have issued so many reversals of their own policies and decisions.” He was referring to the agency’s initial denials that masks are effective at preventing the disease spread and subsequent reversal from that position.

Similar reversals have occurred by the CDC regarding the effectiveness of social distancing and on the issue of whether surfaces should be repetitively cleaned to avoid spreading the disease.

McDonald said that in a recent CDC study, “Eighty-four percent of the people they studied who contracted coronavirus reported to the people running the study that they wore masks ‘all of the time or most of the time.’”

1. Preface & Introduction

Like a television series straight out of science fiction films, such as, V for Vendetta, Pandemic and The Matrix, the mainstream media narrative relentlessly broadcast at “We the People” seemed at first as surreal and as strange as an episode of The Twilight Zone. 

Now, suddenly, and apparently without warning, we are living in a strange hybrid between George Orwell’s novel 1984, Aldous Huxley’s Brave New World and The Matrix. Science fiction has now become real.

George Orwell wisely observed that, “The further a society drifts from the truth, the more it will hate those that speak it.” In 1958, Aldous Huxley warned that, “Pharmacology and propaganda will make the masses love their slavery. As the world is forced into accepting greater and greater levels of government control in all areas of life, remember that nothing in politics happens by chance. There is a science to creating empires.” 

As  the lead character Orpheus revealed in The Matrix film, “The Matrix is everywhere. It is all around us, even now in this very room. You can see it when you look out your window, or when you turn on your television. You can feel it when you go to work, when you go to church, when you pay your taxes. It is the world that has been pulled over your eyes to blind you from the truth.”

These perspectives reflect a deeper sense of what may be happening in our world today. Public Health Legal Authorities to Collect, Use, Share, and Protect Information | ASTHO

Public health agencies need to collect, use, and share information to prevent disease and injury and protect the public against natural, accidental, and intentional health threats. Various federal and state laws may impact public health activities regarding such information.

Public health agencies may collect and maintain information that identifies an individual or is sensitive in nature, such as information about communications systems or detailed emergency response plans. In these situations, freedom of information (FOI) laws establish parameters for information that must be shared, upon request, and that which may be exempted from public disclosure. In applying the laws, public health agencies may need to juggle competing interests and balance individual privacy against the need to protect or inform the public.

Public health agencies face additional challenges when sharing information with law enforcement, especially when conducting a joint investigation where a public health threat may involve criminal activity. Constitutional Considerations

Generally, state and local public health agencies have broad and flexible authority to protect the public health. However, the exercise of governmental power has limits. The United States Constitution contains a Bill of Rights1 that sets out individual liberties and protects individuals from the arbitrary use of governmental power. These rights may impact public health collection and sharing of information.

Right to Privacy
The Constitution provides a limited right to privacy, including “informational privacy.”2 State laws that require reporting of or public health agency access to identifiable information are permissible when they are reasonably directed to the preservation of health and properly respect a patient’s confidentiality and privacy.3

Right Against Unreasonable Search and Seizure
With the owner’s permission,4 public health agencies may enter or search the premises of an individual or business, take biological specimens or environmental samples for testing, copy records, and remove evidence that might be relevant to a public health concern. However, absent consent or the applicability of another exception, public health agencies must comply with requirements in the U.S. Constitution’s Fourth Amendment.

The Fourth Amendment requires that a warrant be obtained, based upon probable cause, to search someone’s premises or seize their property. The Fourth Amendment applies to both criminal investigations and health and safety inspections and investigations.5 In addition to consent, other exceptions to the warrant and probable cause requirement might apply to public health inspections and investigations, including searches of pervasively regulated businesses,6searches of premises or items open to the public,7 and searches based on exigent circumstances if delay is likely to lead to injury, public harm, or the destruction of evidence.8

Right Against Self-Incrimination
The Fifth Amendment right against self-incrimination prevents the government from forcing an individual to be a witness against himself or herself during trial or a custodial interrogation. If an individual is not informed of his or her right against self-incrimination, the individual’s statements and evidence obtained as a result of these statements may be suppressed in criminal proceedings. This right may arise when a public health incident involves criminal activity, especially when law enforcement and public health investigators are conducting joint interviews or public health agencies assist law enforcement to gather evidence.9


Practice Notes

  • Identify information to be obtained or shared.
  • Identify the purpose for which the information is needed.
  • Determine whether this is the minimum necessary for the purpose or whether de-identified information will serve the purpose.
  • Identify sources for the information, such as healthcare providers, schools, other businesses, and individuals.
  • Identify applicable federal or state laws.
  • Determine and meet conditions or requirements for obtaining or sharing information; in some situations, an individual’s consent may avoid legal issues when disclosing private information.
  • If privacy protections prevent disclosures necessary to protect the public, consult with counsel to identify relevant legal responsibilities, evaluate competing moral claims, and document determined course of action.

State Constitutions
State constitutions, along with court decisions that interpret state constitutions, must be reviewed to identify individual rights that exceed the U.S. Constitution. State constitutions may be sources of additional provisions that govern information sharing; for example, some constitutions define individual privacy rights or cover the public’s right to obtain governmental records.

State Statutes

Generally, state law governs state and local public health agencies’ authority and responsibilities regarding collection, use, disclosure, and protection of information. State laws vary in nature and scope. Authority may be based on general statutes, such as public health laws that grant public health agencies communicable disease control authority. Specific laws may also apply.

Case Reporting
These laws mandate that healthcare providers, laboratories, and others report specific communicable diseases and other illness of public health concern. Reporting requirements vary by state, and may also include poisonings, chemical or radiological exposures, suspected acts of terrorism, and other conditions.

Syndromic Surveillance
State laws may require or authorize reporting to electronic syndromic surveillance systems of information that is routinely gathered in emergency rooms or other places that may indicate an emerging disease or other public health threat before confirmed diagnoses are made.

Investigatory Authority
State laws may specifically grant public health agencies authority to conduct investigations and gather evidence, or such authority may arise from general statutory powers. State laws may also establish procedures for obtaining warrants to search the premises of an individual or business and seize evidence related to a public health threat.

Privacy Provisions
Public health or other laws may contain provisions to protect the confidentiality of information that identifies an individual and to limit its disclosure by public health agencies. Exceptions may be provided, for example, for disclosing information to other agencies, law enforcement, or the public when necessary to protect the public’s health.

Freedom of Information
All states have laws that require information held by governmental agencies to be provided upon request. FOI laws promote transparency and accountability of governments, facilitate consumers’ ability to make informed choices, and safeguard citizens against mismanagement and corruption. Public health agencies—like other governmental agencies—need to be sensitive to these important considerations in responding to FOI requests. At the same time, these laws may create challenges for public health agencies with regard to requests for private information about individuals or sensitive information, such as information that is preliminary, incomplete, or might present a national or state security risk. FOI laws include exemptions that may allow public health agencies to withhold private or sensitive information under certain circumstances. These exemptions vary among states in nature, scope, and prerequisites for denying disclosure.

Federal Statutes

Federal laws that impact collection, use, disclosure, and protection of information by public health agencies include, but are not limited to, the following.

HIPAA Privacy Rule
The Privacy Rule10 adopted under the Health Insurance Portability and Accountability Act (HIPAA)11 established national privacy protections for individually identifiable health information. The Privacy Rule may apply to healthcare providers or others that provide information to public health agencies. Depending on a public health agency’s organization, the Privacy Rule may apply to a public health agency when it discloses individually identifiable information. The Privacy Rule is not intended to interfere with public health functions and contains provisions that allow public health agencies to collect identifiable health information and disclose it, including to law enforcement, when authorized by law or when necessary to protect the public from an imminent threat.

FERPA
Privacy protections established by the Family Educational Rights and Privacy Act (FERPA)12 limit information that schools may provide to public health agencies about students. However, exceptions allow schools to provide certain directory information, such as student name and contact information, and necessary information to appropriate officials in cases of health and safety emergencies.13

Surveillance Data Systems
Various federal laws, such as the Public Health Security and Bioterrorism Preparedness Act of 2002,14 establish surveillance data systems that allow collection of information provided by state and local governmental agencies and integration of federal, state, and local data systems.

Critical Infrastructure
Confidentiality requirements apply to federal disclosure of certain information to state or local governmental agencies related to critical infrastructure and supplies and resources to protect the public’s health. For example, federal law protects the confidentiality of information voluntarily provided by the private sector to the federal government regarding vaccine tracking and distribution15 and information about critical infrastructure.16 Although the federal government may share this information with state and local government and agencies, those agencies must protect its confidentiality.

CDC Headquarters As Agency Take Heat Over Coronavirus Testing Kits

A federal investigation found CDC researchers not following protocol.

As the new coronavirus took root across America, the US Centers for Disease Control and Prevention sent states tainted test kits in early February that were themselves seeded with the virus, federal officials have confirmed.

The contamination made the tests uninterpretable, and—because testing is crucial for containment efforts—it lost the country invaluable time to get ahead of the advancing pandemic.

The CDC had been vague about what went wrong with the tests, initially only saying that “a problem in the manufacturing of one of the reagents” had led to the failure. Subsequent reporting suggested that the problem was with a negative control—that is, a part of the test meant to be free of any trace of the coronavirus as a critical reference for confirming that the test was working properly overall.

Now, according to investigation results reported by The New York Times, federal officials confirm that sloppy laboratory practices at two of three CDC labs involved in the tests’ creation led to contamination of the tests and their uninterpretable results.

“Just tragic”

Shortly after the problems became apparent in early February, the Food and Drug Administration sent Timothy Stenzel, chief of in vitro diagnostics and radiological health, to the CDC to investigate what was going wrong. According to the Times, he found a lack of coordination and inexperience in commercial manufacturing.

Problems that led to the contamination included researchers coming and going from labs working on the test kits without changing their coats and researchers sharing lab space to both assemble test components and handle samples containing the coronavirus.

The CDC said in a statement Saturday to the Times that the agency “did not manufacture its test consistent with its own protocol.” Though the CDC appeared reluctant to admit contamination was at the root of the problem, the Times noted that in a separate statement the CDC seemed to acknowledge such problems, saying the agency has since “implemented enhanced quality control to address the issue and will be assessing the issue moving forward.”

After the CDC first sent its test kit to states in early February, it took the agency around a month to fix the problem. By then, the virus had invaded many communities unimpeded, and any chance that the US had at containing its spread had virtually vanished. By mid-March, many states turned to mitigation efforts, such as social distancing, to try to blunt—rather than prevent—the life-threatening, healthcare-overwhelming effects of COVID-19.

“It was just tragic,” Scott Becker, executive director of the Association of Public Health Laboratories, told the Times. “All that time when we were sitting there waiting, I really felt like, here we were at one of the most critical junctures in public health history, and the biggest tool in our toolbox was missing.”

As of the morning of April 20, the US has confirmed more than 760,000 cases of COVID-19 and more than 40,700 deaths. The numbers are expected to be underestimates due to the slow and still limited amount of testing.
