Does Gov. Newsom Have the Power to Shut Down Private Businesses Because of Coronavirus? | California Globe

HM_JF19_Page_37_Image_0001_0Editor’s Note: Finally, a constitutional attorney studies the California Governors martial law powers distinct from emergency powers. The State of California has declared a state emergency on the heels of a national emergency so as to cash in on federal funding  available to the state, but the Governor has not declared martial law. His orders are recommendations with no force of law.

Do counties really have the authority to order everyone to stay at home? Are Shelter in Place Laws Valid?

By Katy Grimes

California Constitutional-Election Law Attorney Attorney Mark Meuser has been questioned so much about the Coronavirus shelter in place orders, and social distancing, he prepared a video and comprehensive explanation of the executive Orders issued by Gov. Gavin Newsom, and California counties public health officials’ orders.

Mark Meuser:

I have been asked by numerous people to help them understand what is going on in the state of California regarding the shutting down of businesses and shelter in place laws. Does the governor really have the power to shut down private businesses? Do counties really have the authority to order everyone to stay at home? This video is my attempt to provide some basic understanding about the difference between martial law and the governor declaring a state of emergency. In this video, we will look at California statutes, the Governors Executive Orders, and the subsequent county health orders of shelter in place. Hopefully as we go through all these documents, you will gain a better understanding of what exactly is going on in this state.

Because of all the misinformation and a lack of information regarding what is going on, if you find this video helpful, can I ask you to share this video on your social media. Tell your friends and family to watch this video so that they can be better educated on what exactly is going on legally that led to all these shelter in place laws.

Please remember that things are changing by the minute and as such, it may not necessarily reflect the most current legal developments. As such, all the information presented here is for general information purposes only and is not intended to be legal advice. You should seek the advice of legal counsel of your choice before acting upon any of the information contained in this video.

First off, let’s start off with the term Martial Law. What is Martial Law, and when can the governor declare Martial Law?

California Military and Veterans Code Section 143 is the statute that gives the Governor authority to proclaim Martial Law. This statute reads:

Whenever the Governor is satisfied that rebellion, insurrection, tumult or riot exists in any part of the state the Governor may, by proclamation, declareto be in a state of insurrection, and he or she may thereupon order into the service of the state any number and description of the active militia, or unorganized militia, as he or she deems necessary, to serve for a term and under the command of any officer as he or she directs.

As you can see, we are not currently in a state of rebellion, insurrection, tumult or riots and as such, the Governor of the State does not have the power to declare martial law. However, that being said, the Governor does have broad powers under the California Emergency Services Act. The California Emergency Services Act can be found starting in California Government Code section 8550.

There are three main types of emergencies that enable a governor to declare a state of emergency.

  1. State of War emergency.
  2. State of Emergency
  3. Local Emergency

I think we all agree that we do not currently have a state of war emergency since neither California or the United State are not under an attack or threat of attack by an enemy of the United States.

As such, that leads us to state of emergency or local emergency. A local emergency deals with disasters that are contained within the limits of a county. Since the Corona virus effects the entire state of California, we are currently dealing with the second option, a State of Emergency.

Under California Government code section 8558, a governor can call a state of emergency when there is an “existence of conditions of disaster or of extreme peril to the safety of persons and property within the state caused by conditions such as air pollution, fire, flood, storm, epidemic, riot, drought, cyberterrorism, sudden and severe energy shortage, plant or animal infestation or disease, …earthquake, or other conditions, other than conditions resulting from a labor controversy or conditions causing a state of war emergency ….”

California Government Code section 8567 states that all orders under the California Emergency Services Act must be in writing and they take effect immediately. When the governor calls a state of emergency, he may suspend any state statute, rule or regulation. (Cal. Gov. § 8571). Please notice that the governor does not have the authority to suspend the California Constitution. As such, any rights contained in the Constitution are still in force. In fact, to make sure the government understands that there are limits to their authority, Cal. Gov. § 8571.5 expressly states that nothing in the California Emergency Services Act gives the government the right to seize or confiscate any firearm or ammunition unless an officer is arresting someone pursuant to an investigation for the commission of a crime.

When a governor calls a state of emergency, this gives him the authority to commandeer or utilize any private property or personnel deemed by him necessary in carrying out the responsibilities. However, the state is liable for the reasonable value of what it uses. (Gov. Code § 8572).

Gov. Newsom’s Executive Orders

Now that we have discussed the law, let’s now talk about what the Governor of California has actually done.

On March 4, 2020, Governor Newsom Declared a State of Emergency.

On March 11, 2020, Governor Newsom’s office published the fact that it was California Department of Public Health’s policy of preventing gatherings of groups larger than 250 people “should be postponed.” This was not an executive order by the governor, instead it was a California Department of Public Health policy. This policy does not cite a single law that gives the California Department of Public Health authority to shut down events of 250 people or require social distancing of more than 6 feet. While these may be good guidelines to follow, they are simply policies, they are not the law.

To emphasize that this was just a policy and not a law, on March 12, 2020, Newsom issues his next executive order (N-25-20). This executive order states that “All residents are to heed any orders and guidance of state and local public health officials, including but not limited to the imposition of social distancing measures, to control the spread of COVID-19.”

Notice the language of this order. “All residents are to heed any orders and guidance …”. If you look up the word heed in the dictionary, you will discover that it means “to give consideration attention to.” It does not say you must obey. Gavin Newsom in his executive order utilizing his powers granted him after declaring a state of emergency told the citizens of California that Californians should takes the advice given by the California Department of Public Health into consideration when making decisions.

Thus, contrary what you may have been led to believe, Gov. Newsom did not actually issue an executive order requiring Californians to practice social distancing, nor did he actually order gatherings of over 250 people to shut down. All he did was order people to pay attention to what these organizations were saying. These were merely recommendations.

Understand, a policy is different from a regulation. While I was able to find authority that allowed the California Department of Health Services to issue emergency regulations after they jumped through a few hoops, I have been unable to find where their policies would have the full force of law. Laws are passed by the legislature, or under the state of emergency, via executive order by the governor.

Before I move on to what the counties have done with their shelter in place laws, I want to quickly let you know that Gov. Newsom has issued five other executive orders in the last several days regarding the Corona virus.

Newsom has signed an executive order on March 13 ensuring funding for schools even if the schools are closed. He has issued an executive order on March 16th on how the state must focus on protecting the health and safety of the most vulnerable. And on March 16th, his executive order dealt with suspending the laws allowing landlords and banks from removing individuals who have not been able to pay their bills until May 31st. On the 17th he signed an executive order to ensure that key commodities can be delivered to California retailers. Finally, on the 18th he issued an executive order to protect ongoing safety net services for the most vulnerable Californians.

Shelter in Place Laws

So now let’s move to the issue of shelter in place laws being issued by the counties. I have not looked at every county’s shelter in place law, but I have looked at several and they are very similar.

California law allows counties to declare a health emergency when the local health officer determines that there is a threat of the introduction of any contagious, infectious, or communicable disease. (California Health and Safety Code § 101080). It appears that this power was not given to the California Department of Health Services but instead, this power was left in the hands of local Health Officers.

Cal. Health & Safety § 101040 permits local health officers to take any preventive measures that may be necessary to protect and preserve the public health from any state of emergency declared by the governor. After a local health emergency has been declared, “The sheriff of each county .. may enforce within the county … all orders of the local health officer issued for the purpose of preventing the spread of any contagious, infectious, or communicable disease.” (Cal. Health and Safety Code 101029). Cal. Health & Safety § 101030 specifically gives the county health officer the authority to order quarantines.

However, the question arises, does a county health officer have the authority to order a quarantine of healthy people, or just those who are sick? What laws are in place in the state of California regarding the stopping of disease through quarantine?

The statutes are very broad in their wording. Cal. Health & Safety § 120175 says that the health officers “shall take measures as may be necessary to prevent the spread of the disease or occurrence of additional cases. Cal. Health & Safety § 120200 indicates that a health officer shall establish and maintain places of quarantine. But this still does not answer the question, can a health officer issue a quarantine of everyone in the county?

In 1921, Laura Culver petitioned the courts to be released from a quarantine. The Court’s held that the law permitted public health officials to quarantine individuals who have come in contact with cases and carriers of contagious diseases.

As one studies California law, it is clear that the law used to be very explicit that a quarantine was only applicable to those who had a contagious disease or those who had come in contact with someone who had a contagious disease.

While most of the laws regarding quarantine are very broad, Cal. Health & Safety § 120215 appears to have limiting language. This statute reads: Upon receiving information of the existence of contagious, infectious, or communicable disease for which the department may from time to time declare the need for strict isolation or quarantine, each health officer shall: (a) Ensure the adequate isolation of each case, and appropriate quarantine of the contacts and premises. (b) Follow the local rules and regulations, and all general and special rules, regulations, and orders of the department, in carrying out the quarantine or isolation.

Let’s look at this for a minute. I think we can all agree that the health officers have sufficient information that there is a communicable disease. However, where we disagree is that the Health Officers are ordering a county wide shelter in place law where the law only allows “adequate isolation of each case, and appropriate quarantine of the contacts.” This is where the local health official appears to have overstepped their authority. The counties are not looking at this on a case by case bases. Instead, they are issuing broad orders that affect both the healthy and the sick. They are not ordering a quarantine of those who have been in contact with someone who has the virus.

Cal. Health & Safety § 120225 also has some instructive language. This statute says that “A person subject to quarantine …”. The quarantine laws where designed to quarantine an individual or a location, not an entire community or organization.

Finally, Cal. Health & Safety § 120235 makes clear that the quarantine powers of the local health officer were never intended to be a community lock down. Cal. Health & Safety § 120235 clearly states that “no quarantine shall be raised until every exposed room, together with all personal property in the room, has been adequately treated, or, if necessary, destroyed, under the direction of the health officer, and until all persons having been under strict isolation are considered noninfectious.”

The quarantine laws are clearly intended to be applied to individuals not to the entire county. The quarantine laws are designed to stop those who might have been infected from passing the disease onto others. Absent the local health officers finding that an individual has the disease or is likely to have the disease, California law does not give them broad authority to quarantine the entire county.

As such, it appears counties such as San Francisco that have issued broad shelter in place laws may be violating California law.

If you feel like the state of emergency called by the governor or these shelter in place laws have adversely effected your business and/or violated your constitutional rights, I would encourage you to seek competent legal counsel to examine your individual case.

In conclusion, we are living in very interesting times. There are those who feel like government officials are in a contest to see who can be the most aggressive in upending the lives of its citizens over the Corona virus. The great debate of today seems to be, is the government doing too much or is the government not doing enough. Regardless of the answer to that question, there are going to be some serious financial ramifications as a result of this virus.

Regardless of whether the government has over reacted or under reacted, the threat of this virus will end. When it does, our generation will have the opportunity to show how we are able to bounce back, just like we did after the Great Depression or 9/11.

The Truth Behind Coronavirus Pandemic: COVID-19 Lockdown & The Economic Crash | London Real

Johnny Liberty, Editor’s Notes: Why Destroy the Global Economic System During the Coronavirus Crisis (and replace it with another that better serves the Global Power Structure)?

  • Global Bankers will pull trillions of dollars of equity out of the economic system (stocks, real estate values, business values) to rollback the debt obligations of the international bankers (because of the nature of the debt-based monetary system)
  • Total Economic Shutdown will destroy millions of family businesses, small businesses and medium sized businesses leaving a larger share to the big, corporate players.
  • Total Economic Shutdown will drop millions of people in countries around the world to the very bottom of the economic ladder. This is economic suicide for We the People and a few thousand dollars of government subsidies will not restore even a fraction of the losses.
  • Don’t believe what you’re being told because somebody in a suit said so. Question authority and do your own independent research.
  • The Coronavirus crisis is not about public health or caring for the elderly.
  • The Global Power Structure doesn’t care one iota about the health and welfare of the elderly. Protecting the elderly is a convenient excuse to destroy the existing economic order and impose a New World Order run by an elite few at the top of the pyramid.
  • Who benefits? The Global Power Structure, or 1%, will be the one who will benefit.
  • What is the result? To impose a Global Technocracy run by experts, scientists, technocrats, politicians and artificial intelligence under their total control. Your every move will be watched and tracked. You will be plugged into “The Matrix”.
  • For this you can thank the Coronavirus panic and overreaction.

Facebook Censoring Former U.S. Congressman Ron Paul Based on Bogus Politifact ‘Fact-Check’ | Ron Paul Institute

FalseinformationfoundonJohnnyLibertySocial media behemoth Facebook has just acted to censor and suppress Ron Paul’s latest weekly column, “The Coronavirus Hoax,” based on a hatchet job “fact check” by the notoriously biased “Politifact” organization.

At issue is Dr. Paul’s statement that National Institute of Allergy and Infectious Diseases director Anthony Fauci’s claim that the coronavirus is “ten times more deadly” than the seasonal influenza virus is “without any scientific basis.” Fauci made the claim recently in testimony before the US Congress in a move that significantly ramped up the fear factor in the US over the virus.

The Politifact “fact check” is literally drenched in sarcasm and bias, with Ron Paul being described as “a sometimes conspiracy-minded Texas doctor” and Fauci described as a “universally trusted person.”

For a “just the facts” analysis, that’s a lot of editorializing.

The Politifact hit piece admits that, “It’s not yet known what the death rate from the current coronavirus, COVID-19, will be,” but concludes nevertheless that, “early data indicate it is more than 10 times higher than the death rate for the flu.”

So if you don’t know how can you know?

One reason to question the “scientific basis” of Fauci’s claim is that Fauci contradicted his own statement before Congress in a recent article he co-authored in the New England Journal of Medicine.

If a scientist writes one thing in a scholarly journal and testifies very differently before Congress, does it not raise questions as to the “scientific basis” of the divergent claims?

Here are the two Anthony Faucis. Which one is scientifically based? Both can’t be:

fa

Founded by the Poynter Institute, Politifact is an outfit with a clear political agenda and it is not to promote truth and accuracy in the media. Rather, it is all about suppressing media outlets with which they disagree. It is all about creating blacklists in a McCarthyite push to control the flow of information.

Interestingly enough, major funders of the Poynter Institute include “open society” advocate George Soros along with Charles Koch (both founders and major funders of the “Quincy Institute“).

Soros loves an “open society” as long as it does not in any way challenge his own political biases. If anyone holds different views, he’ll spend millions to shut down debate.

The Poynter Institute is also funded by the United States government itself, via major grants from the National Endowment for Democracy. So here is what happens when you scratch below the surface a bit: The suppression of views like those of Ron Paul which are unpopular among those who control the foreign policy narrative are actually financed by the US government itself.

Do any of our dear readers support the US government taking our tax money and using it to shut Ron Paul up?

How is it that Facebook tries to sell itself as politically neutral, just making sure only facts are allowed through, while at the same time partnering with such a politically biased and unethical organization as Politifact and the Poynter Institute? Is Facebook really about fostering a lively debate or is it about controlling the narrative favored by the Washington elites?

We have fact-checked Politifact’s fact checkers and we find them to be biased, sloppy, and inimical to the values we should share as Americans in favor of open debate.

And Facebook? End your suppression of Dr. Ron Paul’s op-ed on the coronavirus!

99% of Those Who Died From Virus Had Other Illness, Italy Says | Bloomberg

16Italy-Bodies01-superJumboJim Jordan, Editor’s Note: So why are not these deaths labeled: heart disease, respiratory disease, diabetes, etc? How these deaths are labeled drives the narrative. Yes, if you have underlying serious health conditions this virus could push that person over the edge; however, that does not mean the COVID -19 is THE CAUSE of death in any of these cases. It is a factor that has to be addressed and perhaps if government and health agencies put this in perspective there wouldn’t be this panic and crashing down of the economies, unnecessary fear and its consequences. Addressing chronic health conditions with better policies would mitigate the consequences of these viral outbreaks.

By Tommaso Ebhardt, Chiara Remondini & Marco Bertacche

More than 99% of Italy’s coronavirus fatalities were people who suffered from previous medical conditions, according to a study by the country’s national health authority.

After deaths from the virus reached more than 2,500, with a 150% increase in the past week, health authorities have been combing through data to provide clues to help combat the spread of the disease.

Prime Minister Giuseppe Conte’s government is evaluating whether to extend a nationwide lockdown beyond the beginning of April, daily La Stampa reported Wednesday. Italy has more than 31,500 confirmed cases of the illness.

Screen Shot 2020-03-18 at 4.26.23 PMThe new study could provide insight into why Italy’s death rate, at about 8% of total infected people, is higher than in other countries.

The Rome-based institute has examined medical records of about 18% of the country’s coronavirus fatalities, finding that just three victims, or 0.8% of the total, had no previous pathology. Almost half of the victims suffered from at least three prior illnesses and about a fourth had either one or two previous conditions.

More than 75% had high blood pressure, about 35% had diabetes and a third suffered from heart disease.

Screen Shot 2020-03-18 at 4.27.41 PMThe average age of those who’ve died from the virus in Italy is 79.5. As of March 17, 17 people under 50 had died from the disease. All of Italy’s victims under 40 have been males with serious existing medical conditions.

While data released Tuesday point to a slowdown in the increase of cases, with a 12.6% rise, a separate study shows Italy could be underestimating the real number of cases by testing only patients presenting symptoms.

According to the GIMBE Foundation, about 100,000 Italians have contracted the virus, daily Il Sole 24 Ore reported. That would bring back the country’s death rate closer to the global average of about 2%.

Trump to suspend evictions, authorizes Defense Production Act to mobilize businesses to aid coronavirus response | NBC News

CoronavirusFluColdBy Dartunorro Clark and Rebecca Shabad

The law, enacted in 1950, allows the president to force American businesses to produce materials in the national defense, such as ventilators and medical supplies for health care workers.

President Donald Trump said Wednesday he is invoking the Defense Production Act to mobilize U.S. private production capacity to combat the coronavirus outbreak.

Trump also said his administration is “suspending all foreclosures and evictions until the end of April” to help those affected by the virus.

The Defense Production Act, enacted in 1950, allows the president to force American businesses to produce materials in the national defense, such as ventilators and medical supplies for health care workers.

Trump said the act allows him to do “a lot of good things, if we need it.”

Senate Minority Leader Chuck Schumer, D-N.Y., had earlier called on Trump to use those authorities to address a shortage of medical supplies.

“It’s used in times of war, but we must mobilize as if it were a time of war when it comes to hospital beds, supplies and equipment,” Schumer said Wednesday morning on the Senate floor.

At Wednesday’s press briefing, Trump said he considers himself a “wartime president” and called the coronavirus the “enemy.”

“It comes from China, that’s why,” he said.

Many officials, including the director of the Centers for Disease Control and Prevention, have condemned the phrase, saying it’s inaccurate and potentially harmful because it promotes racist associations between the coronavirus and people from China.

The president also referred to the coronavirus as “the Chinese Virus” during his briefing, as he had in a tweet Wednesday morning and other times in recent days. When asked at the press conference about his use of the phrase amid reports of backlash against Asian Americans because of the coronavirus, the president said it’s “not racist at all.”

Trump said at the briefing that he is activating the Federal Emergency Management Agency in all regions of the country to aid in the coronavirus response. The president also said he is deploying two Navy hospital ships to California and New York as coronavirus cases rise in those two states.

Administration officials also mentioned developments at the Food and Drug Administration that they would announce at a later time.

Earlier Wednesday, Trump announced that the United States and Canada had agreed to close their border to all “nonessential traffic” because of the spread of the coronavirus.

What the Dow’s 28% Crash Tells Us About the Economy | Bloomberg

2400x-1Johnny Liberty, Editor’s Note: This is exactly why we stayed out of the markets due to the possibility of extreme fluctuation due to events beyond our control (e.g., coronavirus). This market adjustment was long overdue and the Power Structure took advantage of the “panic” in partnership with Big Media to remove trillions of dollars of value.

By Dave Merrill and Esha Dey

It is hard to follow the stomach–turning plunge across financial markets without hearing a reference to the Dow.

Professional money managers, as well as casual investors, often look at the Dow—or the Dow Jones Industrial Average—to get a 30-thousand feet view of the markets. Referred to as simply the Dow, it is a price–weighted average of 30 blue–chip U.S. stocks that are generally the leaders in their industry.

Amid the current carnage, observing the index can help in gauging the damage the coronavirus is inflicting on portfolios, and whether the downturn is a short-turn consequence of disrupted supply chains and skittish consumer demand or a broader symptom of a bull market that has run its course.

To better understand the differing aspects of the economy and the signals they are flashing, we have grouped the 30 Dow stocks into nine broad economic sectors—health care, energy, consumer staples, communication services, information technology, consumer discretionary, financials, industrials and basic materials. Here is an overview of the U.S. stock market through the lens of the Dow.

Graphic1

Components of a 8,300-Point Drop

Critics of the Dow say that it inaccurately portrays the general market as stocks with a higher price, such as Apple and Boeing, are over represented. Boeing is a relevant example as its current decline does not only reflect troubles related to the coronavirus outbreak, but also its ongoing crisis that was triggered by two fatal crashes of its 737 Max jet within a span of five months early last year. However, it is now the most significant contributor to the Dow’s drop since its peak on Feb. 12.

Graphic2

Percentage Drop by Industry Sectors, Best to Worst Performing

As shown in the chart above, certain stocks, such as Walmart, have been fairly resilient, with consumer staples as a group faring better than the rest overall. On average, stocks in four other sectors, health care, communications services, information technology and consumer discretionary are performing better than the overall drop of 28% in the Dow.

Consumer Staples

-7.7%
These consumer products are those that remain in family budgets regardless of financial problems in the larger economy, and are expectedly doing relatively better than the rest of the index. Walmart’s stock is seen as a “place to hide” amid the looming threat of a recession, while grocery sales overall are surging as consumers stock up and get ready to wait out the pandemic.

Health Care

-13.6%
Shares of pharmaceutical and biotechnology drug developers have done well amid the widespread panic, as several companies unveiled plans to combat Covid-19. At the same time, investors soured on the nation’s hospitals, which already saddled with debt, may feel an increased pressure as elective surgeries are delayed. Also, if the economy slides into a recession, it might mean the hospitals would get more patients that are covered by Medicare and Medicaid, which are less profitable, as well as see an increase in unpaid bills.

Communication Services

-20.4%
While the Dow includes just two companies from this group—Walt Disney and Verizon—overall, the sector’s stocks have done better than the broader market given a mixed exposure to the virus spread. The crisis has led to a drastic drop in ticket sales at movie theaters, yet, another part of the sector—like wireless service provider Verizon—remains largely insulated from any coronavirus impact, though equipment sales could see some declines due to supply constraints and store closings.

Information Technology

-25.5%
Technology companies—be it IBM, Apple or Microsoft—are being seen as reasonably defensive as patient investors look ahead to key tailwinds in 5G technologies, cloud computing products and artificial intelligence, even though strained global supply chains may have put a dent in near-term optimism.

Consumer Discretionary

-30.8%
Discretionary spends, such as buying new shoes, clothes, furnitures or cars, or even eating out, are expected to go down, reflected in the sharp decline seen in the stocks of Nike and McDonald’s. Restaurant stocks have continued to slide, as more companies shifted to takeout only, either by choice or state/city mandate, while cruise-line operators’ stocks are in a freefall.

Financials

-32.4%
Financial companies have been among the hardest hit as the virus threatened to tip the economy into a recession, with the KBW index of top U.S. banks falling nearly 40% since mid-February when the broader virus-fueled selloff began. With the Federal Reserve slashing its benchmark rate to near zero over the weekend, banks’ profits are expected to feel the squeeze, along with rising concern that borrowers may not be able to pay back loans in a faltering economy.

Industrials

-37.6%
With the virus outbreak forcing social distancing, and keeping people from buying cars or taking flights, the impact is rippling through the manufacturing industry and its supply chain. Factories and plants across the globe are being forced to shut down. Boeing, which was already struggling to sort out its troubles related to the 737 Max aircraft that was grounded last year after two fatal crashes, is now facing a double whammy as the airline industry sees an unprecedented drop in demand. That may, in turn, force airlines to defer their aircraft orders, or even cancel some if the situation does not improve in a few more months. The overall investor nervousness is also reflected in the shares of Caterpillar and United Technologies, two stocks that can be seen as bellwethers of the global industrial economy.

Energy

-38.4%
Energy stocks are taking a beating as the sector faces demand headwinds from coronavirus, while the ongoing price war between Saudi Arabia and Russia isn’t helping anyone’s cause. Energy is the worst-performing group in the S&P 500 this year, down 54%. Meanwhile, U.S. shale drillers are responding by slashing their capital budgets and dividends in a bid to weather the downturn.

Materials

-46.1%
The S&P 500 Materials index has lost about 28% since the rout started on Feb. 21. The worst hit sectors were chemical, fertilizer and industrial metals, all of which depend on the global economy for the demand of their products. The pullback led to fertilizer maker Mosaic Co. and plastic producer LyondellBasell Industries N.V. to lose about 50% of their stock value since the sell-off began. Meanwhile, gold miner Newmont Corp. was the least affected stock within the materials, as gold prices held up relatively well amid global panic selling.

Recoveries from Collapse

Since the 1980s, the Dow has recorded three other losses of more than 25% from previous highs. Historically, recoveries from these lows have taken many months.

The U.S. Wants Smartphone Location Data to Fight Coronavirus. Privacy advocates are worried | NBC News

Once they have that power, they’ll always have it (and will eventually abuse it). For example, the USA Patriot Act continues to be in force today without a tangible terrorist threat. Your civil liberties and sovereign rights continue to be compromised daily.

Federal health officials say they could use anonymous, aggregated user data collected by the tech companies to map the spread of the virus.

The White House and the Centers for Disease Control and Prevention are asking Facebook, Google and other tech giants to give them greater access to Americans’ smartphone location data in order to help them combat the spread of the coronavirus, according to four people at companies involved in the discussions who are not authorized to speak about them publicly.

Federal health officials say they could use anonymous, aggregated user data collected by the tech companies to map the spread of the virus — a practice known as “syndromic surveillance” — and prevent further infections. They could also use the data to see whether people were practicing “social distancing.”

Some sources stressed that the effort would be anonymized and that government would not have access to specific individuals’ locations. They noted that users would be required to opt-in to the effort.

The federal effort, first reported by The Washington Post, will force the tech giants to weigh their commitments to user privacy against their desire to help combat a disease that has cost thousands of human lives and upended the global economy.

Full coverage of the coronavirus outbreak

The government officials have held at least two calls in recent days with representatives from the companies, the sources said. Those officials are “very serious” about making this happen, a person at one of the tech companies said.

Similar and more aggressive surveillance practices have already been put to use in China, South Korea and Israel. The moves have set off alarm bells among privacy advocates who fear what the government may do with users’ data.

Facebook already provides health researchers and nongovernmental organizations in some countries with anonymized data to help disease prevention efforts. Laura McGorman, policy lead of Facebook’s “Data for Good” program, said a similar effort could be used “to understand and help combat the spread of the virus.”

But other sources warned that providing the government with greater access to anonymized location data now could lead to the erosion of individual privacy down the line, especially if the government starts to ask for non-anonymized data.

Representatives from Facebook, Google, Twitter, Apple, Amazon, Microsoft, IBM and Cisco all took part in the call with White House and federal health officials. Spokespeople for the companies declined to comment on the discussions.

Governments love crises because when the people are fearful they are more willing to give up freedoms for promises that the government will take care of them. After 9/11, for example, Americans accepted the near-total destruction of their civil liberties in the PATRIOT Act’s hollow promises of security.

It is ironic to see the same Democrats who tried to impeach President Trump last month for abuse of power demanding that the Administration grab more power and authority in the name of fighting a virus that thus far has killed less than 100 Americans.

Declaring a pandemic emergency on Friday, President Trump now claims the power to quarantine individuals suspected of being infected by the virus and, as Politico writes, “stop and seize any plane, train or automobile to stymie the spread of contagious disease.” He can even call out the military to cordon off a US city or state.

State and local authoritarians love panic as well. The mayor of Champaign, Illinois, signed an executive order declaring the power to ban the sale of guns and alcohol and cut off gas, water, or electricity to any citizen. The governor of Ohio just essentially closed his entire state.

The chief fearmonger of the Trump Administration is without a doubt Anthony Fauci, head of the National Institute of Allergy and Infectious Diseases at the National Institutes of Health. Fauci is all over the media, serving up outright falsehoods to stir up even more panic. He testified to Congress that the death rate for the coronavirus is ten times that of the seasonal flu, a claim without any scientific basis.

On Face the Nation, Fauci did his best to further damage an already tanking economy by stating, “Right now, personally, myself, I wouldn’t go to a restaurant.” He has pushed for closing the entire country down for 14 days.

Over what? A virus that has thus far killed just over 5,000 worldwide and less than 100 in the United States? By contrast, tuberculosis, an old disease not much discussed these days, killed nearly 1.6 million people in 2017. Where’s the panic over this?

If anything, what people like Fauci and the other fearmongers are demanding will likely make the disease worse. The martial law they dream about will leave people hunkered down inside their homes instead of going outdoors or to the beach where the sunshine and fresh air would help boost immunity. The panic produced by these fearmongers is likely helping spread the disease, as massive crowds rush into Walmart and Costco for that last roll of toilet paper.

The madness over the coronavirus is not limited to politicians and the medical community. The head of the neoconservative Atlantic Council wrote an editorial this week urging NATO to pass an Article 5 declaration of war against the COVID-19 virus! Are they going to send in tanks and drones to wipe out these microscopic enemies?

People should ask themselves whether this coronavirus “pandemic” could be a big hoax, with the actual danger of the disease massively exaggerated by those who seek to profit – financially or politically – from the ensuing panic.

That is not to say the disease is harmless. Without question people will die from coronavirus. Those in vulnerable categories should take precautions to limit their risk of exposure. But we have seen this movie before. Government over-hypes a threat as an excuse to grab more of our freedoms. When the “threat” is over, however, they never give us our freedoms back.

The Coronavirus COVID-19 Pandemic: The Real Danger is “Agenda ID2020” | Global Research

Screen-Shot-2020-03-12-at-12.06.03

Johnny Liberty, Editor’s Note: If the author of this article hadn’t worked for the World Bank and World Health Organization for decades I might have hesitated in publishing this article. But the premise for forced vaccinations are now more believable than ever as an objective of the Coronavirus crisis (engineered by the overreaction of global, national, state and local governments.

By Peter Koenig

What is the infamous ID2020? It is an alliance of public-private partners, including UN agencies and civil society. It’s an electronic ID program that uses generalized vaccination as a platform for digital identity.

“It seems, the more there is written about the causes of the Coronavirus – the more the written analyses are overshadowed by a propaganda and fear-mongering hype. Questions for the truth and arguments for where to look for the origins and how the virus may have spread and how to combat it, are lost in the noise of wanton chaos. But isn’t that what the “Black Men” behind this intended pandemic want – chaos, panic, hopelessness, leading to human vulnerability – a people becoming easy prey for manipulation?”

Today WHO declared the coronavirus COVID-19 a “pandemic” – when there is not the slightest trace of a pandemic. A pandemic might be the condition, when the death to infection rate reaches more than 12%. In Europe, the death rate is about 0.4%, or less. Except for Italy which is a special case, where the peak of the death rate was 6% (see below for further analysis).

China, where the death rate peaked only a few weeks ago at about 3%, is back to 0.7% – and rapidly declining, while China is taking full control of the disease – and that with the help of a not-spoken-about medication developed 39 years ago by Cuba, called “Interferon Alpha 2B (IFNrec)”, very effective for fighting viruses and other diseases, but is not known and used in the world, because the US under the illegal embargo of Cuba does not allow the medication to be marketed internationally.

WHO has most likely received orders from “above”, from those people who also manage Trump and the “leaders” (sic) of the European Union and her member countries, those who aim to control the world with force – the One World Order.

This has been on the drawing board for years. The final decision to go ahead NOW, was taken in January 2020 at the World Economic Forum (WEF) in Davos – behind very much closed doors, of course. The Gates, GAVI (an association of vaccination-promoting pharmaceuticals), Rockefellers, Rothschilds et al, they are all behind this decision – the implementation of Agenda ID2020.

After the pandemic has been officially declared, the next step may be – also at the recommendation either by WHO, or individual countries, “force vaccination”, under police and/or military surveillance. Those who refuse may be penalized (fines and / or jail – and force-vaccinated all the same).

If indeed force-vaccination will happen, another bonanza for Big Pharma, people really don’t know what type of cocktail will be put into the vaccine, maybe a slow killer, that acts-up only in a few years – or a disease that hits only the next generation – or a brain debilitating agent, or a gene that renders women infertile …. all is possible – always with the aim of full population control and population reduction. In a few years’ time, one doesn’t know, of course, where the disease comes from. That’s the level of technology our bio-war labs have reached (US, UK, Israel, Canada, Australia…).

Another hypothesis, at this point only a hypothesis, but a realistic one, is that along with the vaccination – if not with this one, then possibly with a later one, a nano-chip may be injected, unknown to the person being vaccinated. The chip may be remotely charged with all your personal data, including bank accounts – digital money. Yes, digital money that’s what “they” are aiming at, so you really have no control any more over your health and other intimate data, but also over your earnings and spending. Your money could be blocked, or taken away – as a ‘sanction’ for misbehavior, for swimming against the stream. You may become a mere slave of the masters. Comparatively, feudalism may appear like a walk in the park.

It’s not for nothing that Dr. Tedros, DG of WHO, said a few days ago, we must move towards digital money, because physical paper and coin money can spread diseases, especially endemic diseases, like the coronavirus. A precursor for things to come? – Or for things already here? – In many Scandinavian countries cash is largely banned and even a bar of chocalate can be paid only electronically.

We are moving towards a totalitarian state of the world. This is part of Agenda ID2020 – and these steps to be implemented now – prepared since long, including by the coronavirus computer simulation at Johns Hopkins in Baltimore on 18 October 2019, sponsored by the WEF and the Bill and Melinda Gates Foundation.

Bill Gates, one of the chief advocates of vaccinations for everybody, especially in Africa – is also a huge advocate of population reduction. Population reduction is among the goals of the elite within the WEF, the Rockefellers, Rothschilds, Morgens – and a few more. The objective: fewer people (a small elite) can live longer and better with the reduced and limited resources Mother Earth is generously offering.

This had openly been propagated already in the 1960s and 70s by Henry Kissinger, Foreign Secretary in de Nixon Administration, a co-engineer of the Vietnam war, and main responsible for the semi-clandestine bombing of Cambodia, a genocide of millions of unarmed Cambodian civilians. Along with the CIA-Kissinger engineered coup on 9/11, 1973, in Chile, killing the democratically elected Salvador Allende and putting the military dictator Pinochet in power, Kissinger has committed war crimes. Today, he is a spokesman (so to speak) for Rockefeller and their  “Bilderberger Society”.

Two weeks after the computer simulation at Johns Hopkins Medical Center in Baltimore, Maryland, that “produced” (aka simulated) 65 million deaths (!), the COVID-19 virus first appeared in Wuhan. By now it is almost certain that the virus was brought to Wuhan from outside, most likely from a bio-war lab in the US. See also this and this.

What is the infamous ID2020? It is an alliance of public-private partners, including UN agencies and civil society. It’s an electronic ID program that uses generalized vaccination as a platform for digital identity. The program harnesses existing birth registration and vaccination operations to provide newborns with a portable and persistent biometrically-linked digital identity. GAVI, the Global Alliance for Vaccines and Immunization, identifies itself on its website as a global health partnership of public and private sector organizations dedicated to “immunization for all”. GAVI is supported by WHO, and needless to say, its main partners and sponsors are the pharma-industry.

The ID2020 Alliance at their 2019 Summit, entitled “Rising to the Good ID Challenge”, in September 2019 in New York, decided to roll out their program in 2020, a decision confirmed by the WEF in January 2020 in Davos. Their digital identity program will be tested with the government of Bangladesh. GAVI, the Vaccine Alliance, and “partners from academia and humanitarian relief” (as they call it), are part of the pioneer party.

Is it just a coincidence that ID2020 is being rolled out at the onset of what WHO calls a Pandemic? – Or is a pandemic needed to ‘roll out’ the multiple devastating programs of ID2020?

Here is what Anir Chowdhury, policy advisor of the Bangladesh government program, has to say:

“We are implementing a forward-looking approach to digital identity that gives individuals control over their own personal information, while still building off existing systems and programs. The Government of Bangladesh recognizes that the design of digital identity systems carries far-reaching implications for individuals’ access to services and livelihoods, and we are eager to pioneer this approach.”

Wow! Does Mr. Anir Chowdhury know what he is getting into?

Back to the Pandemic and the panic. Geneva, the European seat of the United Nations, including the headquarters of WHO, is basically shot down. Not unlike the lock-down that started in Venice and later expanded to northern Italy until a few days ago – and now the lock-down covers all of Italy. Similar lock-down may soon also be adopted by France – and other European vassal states to the Anglo-Zionist empire.

Numerous memoranda with similar panic-mongering contents from different UN agencies in Geneva are circulating. Their key message is – cancel all mission travel, all events in Geneva, visits to the Palais des Nations, the Geneva Cathedral, other monuments and museums. The latest directives, many agencies instruct their staff to work from home, not to risk contamination from public transportation.

This ambiance of panic and fear – outstrips any sense of reality, when the truth doesn’t matter. People can’t even think any more about the causes and what may be behind it. Nobody believes you (anymore), when you refer to Event 201, the coronavirus simulation, the Wuhan Military Games, the closing last August 7, of the high-security biological war lab at Fort Detrick, Maryland…. what could have at one point been an eye opener for many, today is sheer conspiracy theory. The power of propaganda. A destabilizing power – destabilizing countries and people, destroying economies, creating hardship for people who may lose their jobs, usually the ones who can least afford it.

Also, at this time it becomes increasingly important to remind people that the outbreak in China was targeting the Chinese genome. Did it later mutate to transgress the ‘borders’ of Chinese DNA? When did that happen, if it happened? Because at the beginning it was clear that even the infected victims in other parts of the world, were to 99.9% of Chinese descent.

What happened later, when the virus spread to Italy and Iran, is another issue, and opens the way to a number of speculations.

(i) There were various strains of the virus circulated in sequence – so as to destabilize countries around the world and to confound the populace and media, so that especially nobody of the mainstream may come to the conclusion that the first strain was targeting China in a bio-war.

(ii) In Iran, I have a strong suspicion that the virus was an enhanced form of MERS (Middle East Respiratory Syndrome, man-made, broke out first in Saudi Arabia in 2012 , directed to the Arabic genome) – which was somehow introduced into government circles (by aerosol spray?) – with the goal of “Regime Change” by COVID19-caused death. Its Washington’s wishful thinking for at least the last 30 years.

(iii) In Italy – why Italy? – Maybe because Washington / Brussels wanted to hit Italy hard for having been officially the first country to sign a Belt and Road (BRI) accord with China (actually the first was Greece, but nobody is supposed to know that China came to the rescue of Greece, destroyed by Greece’s brothers, the EU members, mainly Germany and France).

(iv) The hype about the high death to infection rate in Italy, as of the time of this writing: 10,149 infections vs. 631 deaths = death rate of 6.2 (comparatively Iran: 8042 infections vs. 291 deaths = 3.6 death rate). The death rate of Italy is almost double that of Iran and almost ten-fold that of average Europe. (Are these discrepancies the result of failures in the establishing reliable data pertaining to “infections”, see our observations pertaining to Italy below).

Why? – Was is Italy being affected with virus panic? Was there a much stronger strain introduced to Italy?

The common flu in Europe in the 2019 / 2020 season, has apparently so far killed about 16,000 (in the US the death toll is, according to CDC between 14,000 and 32,000, depending on which CDC website you look at).

Could it be that among the Italian coronavirus deaths there were also common flu victims, as the affected victims are mostly elderly with respiratory preconditions? Also, symptoms are very similar between coronavirus and the common flu, and nobody questions and checks the official authorities’ narrative?

Maybe not all the coronavirus strains come from the same laboratory. A journalist from Berlin of Ukrainian origin, told me this morning that Ukraine is host to some 5 high security US bio-war labs. They test regularly new viruses on the population – yet, when strange diseases break out in the surroundings of the labs, nobody is allowed to talk about it. Something similar, she says, is happening in Georgia, where there are even more Pentagon / CIA bio-war labs – and where also new and strange diseases break out.

All of this makes the composite picture even more complicated. Overarching all is this super hype is profit driven, the quest for instant profit, instant benefits from the suffering of the people. This panic making is a hundred-fold of what it’s worth. What these kingpins of the underworld, who pretend to run the upper world, perhaps miscalculated, is that in today’s globalized and vastly outsourced world the west depends massively on China’s supply chain, for consumer goods, and for intermediary merchandise – and, foremost for medication and medical equipment. At least 80% of medication or ingredients for medication, as well as for medical equipment comes from China. The western China dependence for antibiotics is even higher, some 90%.  The potential impacts on health are devastating.

During the height of the COVID-19 epidemic China’s production apparatus for everything was almost shut-down. For deliveries that were still made, merchandise vessels were regularly and categorically turned back from many harbors all around the world. So, the west has tricked itself into a shortage-of-everything mode by waging a  de facto “economic war” on China. How long will it last? – Nobody knows, but China’s economy which was down by about half, has rapidly recovered to above 80% of what it was before the coronavirus hit. How long will it last to catch up with the backlog?

What is behind it all? – A total crackdown with artificially induced panic to the point where people are screaming “help, give us vaccinations, display police and military for our security” – or even if the public despair doesn’t go that far, it would be easy for the EU and US authorities to impose a military stage of siege for “health protection of the people”. In fact, CDC (Center for Disease Control in Atlanta), has already designed harshly dictatorial directives for a “health emergency”.

Along with forced vaccination, who knows what would be contained in the cocktail of ‘’mini-diseases” injected, and what their long-term effects might be. Similar to those of GMOs, where all sorts of germs could be inserted without us, the commons, knowing?

We may indeed be just at the beginning of the implementation of ID2020 – which includes, forced vaccination, population reduction and total digital control of everybody – on the way to One World Order – and global financial hegemony – Full Spectrum Dominance, as the PNAC (Plan for a New American Century) likes to call it.

A windfall for China. China has been purposely targeted for “economic destruction”, because of her rapidly advancing economy, an economy soon to overtake that of the now hegemon, the US of A, and because of China’s strong currency, the Yuan, also potentially overtaking the dollar as the world’s main reserve currency.

Both occurrences would mean the end of US dominance over the world. The coronavirus disease, now in more than 80 countries, has crashed the stock markets, a decline of at least 20% over the last few weeks – and rising; the feared consequences from the virus of an economic slow-down, if not recession, has slashed petrol prices within about two weeks almost in half. However, without China’s central bank interference, the Yuan’s value vis-à-vis the dollar has been rather stable, at around 7 Yuan to the dollar. That means, the Chinese economy, despite COVID-19, is receiving still much trust around the globe.

Advice to China – buy all the US and European corporate shares you can at current rock-bottom prices from the stock markets that collapsed by a fifth or more, plus buy lots of oil futures. When the prices recover, you have not only made billions, probably trillions from the west, but you also may own or hold significant and influence-yielding amounts of shares in most of the largest US and European corporations – and will be able to help call the shots of their future endeavors.

There is however, one little silver lining oscillating at the horizon full of dark clouds. It could miraculously be an awakening of consciousness of a critical mass that could put an end to it all. Although, we seem to be far from such a miracle, somewhere in a hidden corner of our brain, we all have a spark of consciousness left. We have the spiritual capacity to abandon the disaster path of western neoliberal capitalism, and instead espouse solidarity, compassion and love for each other and for our society. That may be the only way to break the gridlock and doom of western egocentric greed.

Coronavirus will bankrupt more people than it kills — and that’s the real global emergency | MSN

BB115Vng.img
By Omar Hassan

Coronavirus’s economic danger is exponentially greater than its health risks to the public. If the virus does directly affect your life, it is most likely to be through stopping you going to work, forcing your employer to make you redundant, or bankrupting your business.

The trillions of dollars wiped from financial markets this week will be just the beginning, if our governments do not step in. And if President Trump continues to stumble in his handling of the situation, it may well affect his chances of re-election. Joe Biden in particular has identified Covid-19 as a weakness for Trump, promising “steady, reassuring” leadership during America’s hour of need.

Provided by The IndependentWorldwide, Covid-19 has killed 4,389 with 31 US deaths as of today. But it will economically cripple millions, especially since the epidemic has formed a perfect storm with stock market crashes, an oil war between Russia and Saudi Arabia, and the spilling over of an actual war in Syria into another potential migrant crisis.

We may look back on coronavirus as the moment when the threads that hold the global economy together came unstuck; and startups and growing businesses like mine could end up paying the price.

Just as important as fighting the virus — if not more important — is vaccinating our economies against the incoming pandemic of panic. Human suffering can come in the form of illness and death. But it can also be experienced as not being able to pay the bills or losing your home.

Small businesses in particular are struggling as supply chains dry up, leaving them without products or essential materials. Factory closures in China have led to a record low in the country’s Purchasing Manager’s Index which measures manufacturing output. China is the world’s largest exporter and is responsible for a third of global manufacturing, so China’s problem is everyone’s problem — even in the midst of a trade war between the White House and Beijing.

All this makes it even more worrying that governments continue to see this as a health crisis, not an economic one. It is time the economists took over from the doctors, before the real pandemic spreads.

It is difficult to imagine Italy not entering a recession (the world’s ninth-largest economy is now on lockdown). It is also difficult to imagine that failing to affect Europe and its largest trading partner, the United States. And it is impossible to see how any of this will not add up to a global downturn, unless governments step in faster and harder than they did 12 years ago during the last financial crisis.

The stakes are higher this time, because there seems to be a coordinated effort to economically hurt many Western countries, and warn them away from the aggressive trade policies that Trump has so enthusiastically adopted.

Although China bore the brunt of the virus’s economic and human cost, many in Beijing will see a silver lining in the weakening of the US economy, and a distraction from Trump’s trade wars that appeared to be escalating with no end in sight.

Almost perfectly synchronized with the coronavirus, a Russia-Saudi oil war has erupted. In the short-term, both Moscow and Riyadh can afford the 30 per cent overnight drop in the oil price. But America’s shale gas business cannot: The more expensive process of fracking means that much of the US oil sector will simply not exist if oil prices stay at historic lows, leading to shut downs, job losses and perhaps even state-level recessions.

President Trump has pushed through overdue payroll tax cuts and help for hourly workers — measures that will help both employers and employees survive. In the UK, Chancellor Rishi Sunak yesterday unveiled a ‘Coronavirus Budget’. But everyone needs to think bigger if they want to properly deal with how this new factor changes the status quo.

This is about much more than coronavirus, oil prices, or even the global economy. This is about the balance of power between East and West. The epicenter of this has been, for the last 10 years, Syria. After a decade of conflict on the ground, the face-off seems to have now escalated from proxy war to economic conflict. The emerging superpowers of Russia and China witnessed what many saw as American irrelevance in Syria. And they are now trying to cement their vision of a truly multi-polar world. Rather than allowing US ally Saudi Arabia to lead the oil markets through the OPEC cartel, Russia and China want to reshape global markets — and power balances — to their advantage.

To survive these shifts, the US, UK and others will need to protect the future of their businesses, large and small, and look for opportunities to benefit from the new economic world order, not deny it. Ignoring these changes will be even more damaging than any flu pandemic.
